Facial Data Collection Service Agreement
Dear user, to facilitate a secure and convenient real-name authentication of Spring Airlines' SpringPass Membership, we will assist you with facial recognition authentication through this service.
The Service involves processing your sensitive personal information (facial recognition data). In accordance with the Personal Information Protection Law of the People's Republic of China and other relevant laws and regulations, separate consent must be obtained from you for the processing of personal sensitive information.
To protect your legal rights, please carefully read and fully understand the entire content of this Agreement before clicking "Agree" or otherwise confirming it, especially the terms highlighted in bold font.
If you have any questions about this Agreement, please refrain from proceeding further and feel free to contact us through Spring Airlines' official customer service at any time. By clicking "Agree" or continuing to use the Service, you confirm that you are at least 18 years old, have fully read, understood, and agreed to all the terms of this Agreement, and consent to our processing of your relevant personal information for the purpose of providing the Service.
1. Service and Definition
  • 1.1 Facial Recognition Authentication Service ("the Service"): Refers to the service provided by Spring Airlines Co., Ltd. ("we" or "Spring Airlines") to assist you in completing the real-name authentication for the "SpringPass Membership". This involves verifying your identity by entrusting a third-party technical service provider to collect facial information provided during the authentication process and comparing it with the photo information from your submitted identity documents (such as passport, Mainland Travel Permit for Hong Kong and Macao Residents, or Mainland Travel Permit for Taiwan Residents).
  • 1.2 Applicable subjects: The Service is currently primarily available to passengers holding valid documents such as passport, Mainland Travel Permit for Hong Kong and Macao Residents (Home Return Permit), or Mainland Travel Permit for Taiwan Residents.
2. Your Authorization and Consent
  • 2.1 For the purpose of the Service, you understand and explicitly agree to authorize us and the third-party technical service providers we entrust to collect and process the following personal information during this authentication process:
(a) The basic personal information you have already provided when applying for Spring Airlines' SpringPass Membership service (such as name, ID number, mobile phone number, etc.).
(b) The photo of your identity document uploaded for this authentication;
(c) Your facial information collected in real-time during this authentication process (classified as sensitive personal information).
  • 2.2 You agree that we may provide the above information to third-party technical service providers solely for completing this identity comparison and verification.
  • 2.3 Data security commitment: We solemnly promise that neither we nor our authorized third-party technical service providers will store your identity document photos or facial information after completing this facial recognition authentication. The authentication result (either pass or fail) will be returned to us to complete your member registration process.
3. Your Rights and Obligations
  • 3.1 You shall ensure that you are the lawful holder of the identity documents and guarantee that all information and materials provided are true, accurate, lawful, and valid. You shall bear all legal consequences arising from providing false information or impersonating others.
  • 3.2 You shall use the Service in a secure environment and properly safeguard your personal devices.
  • 3.3 You shall not use the Service for domains restricted or prohibited by Chinese laws and regulations or contrary to moral customs, otherwise you shall bear all resulting liabilities and losses. If this causes losses to us or any third party, you shall compensate accordingly.
  • 3.4 You understand that the Service relies on the current technological level. We will strive to ensure the effective and normal operation of facial data collection based on the existing technological capabilities and make every effort to improve the accuracy of the collection results. However, as the technological capabilities we can use for facial data collection are continuously being upgraded and improved, we cannot currently guarantee that you will definitely be able to complete facial data collection. Please understand that to protect your or others' legitimate rights and interests, we may suspend providing facial data collection-related services to you when we believe there may be risks.
4. Our Rights and Obligations
  • 4.1 We will provide you with the Service in accordance with the terms of this Agreement.
  • 4.2 We will continuously adjust and improve the content and form of the Service in accordance with the development of facial data collection technology and the requirements of the market risk environment.
  • 4.3 We will, based on the Privacy Statement, strictly protect your information, and this Agreement serves as a supplement to the privacy policy and specifically stipulates the rules for processing personal information in facial recognition authentication scenarios. Please read this policy carefully. If you have any questions, feel free to contact us at any time.
  • 4.4 We promise to keep your personal informationstrictly confidential, and conduct secure data transmission and encrypted data storage by using nationally recognized encryption algorithms. However, we shall not be liable for any user losses caused by force majeure, cyber attacks, system failures, communication failures, computer viruses, malicious program attacks, or other circumstances not attributable to us.
  • 4.5 We will sign confidentiality agreements with partner institutions, requiring them to guarantee user information security and fulfill their obligations for information protection.
5. Special Agreements
  • 5.1 You understand and agree that given the inherent characteristics of internet and biometric technologies, the following circumstances shall not be considered as Spring Airlines breaching the contract, and we shall not be liable for any losses incurred to you:
(a) Force majeure events including natural disasters such as floods, earthquakes, epidemics, etc. and social events such as wars, riots, or government actions that result in service unavailability or interruption;
(b) Service interruption or data breaches caused by factors beyond our control, including hacker attacks, computer viruses, interruption of telecommunication trunk lines, system instability, third-party service defects, or government regulations. Nevertheless, we will promptly take reasonable emergency measures to minimize your losses;
(c) Server configuration and maintenance will require brief service interruptions;
(d) Network congestion may cause slower access to the website;
(e) Service may be suspended or terminated due to the relevant requirements of national laws and regulations and policies.
6. Others
  • 6.1 To further improve user experience, we will continuously update our services, providing users with version upgrades, feature enhancements, rule updates, and other service/content updates. This Agreement may also be updated accordingly. We will notify you of agreement updates through announcements, client notifications, SMS, pop-ups, or other means (collectively referred to as "notifications"). The updates will take effect on the specified date in such notifications. If you disagree with the updated terms, you have the right to discontinue using the relevant services. If both parties reach mutual agreement, the related services and corresponding terms may also be modified separately. Your continued use of the service after the new agreement takes effect constitutes acceptance of the updated terms.
  • 6.2 This Agreement forms an integral part of Spring Airlines' User Service Agreement and Privacy Policy. Matters not covered herein shall be governed by the provisions of the aforementioned agreements. In case of any inconsistency between this Agreement and the aforementioned agreements regarding facial recognition authentication services, this Agreement shall prevail.
  • 6.3 Please understand that to meet your diverse needs and provide better services to you, we may transfer part or all services under this Agreement to our affiliated entities for operation or fulfillment when adjusting business strategies. In the event of mergers, divisions, acquisitions, or asset transfers, we may also transfer relevant assets under the Service to third parties.
  • 6.4 This Agreement shall be governed by the laws of the People's Republic of China (solely for the purpose of this Agreement, excluding the laws of Hong Kong Special Administrative Region, Macao Special Administrative Region, and Taiwan region). Any disputes under this Agreement shall be resolved through friendly negotiations between both parties. If negotiations fail, both parties agree to submit the dispute to the People's Court in the jurisdiction where Spring Airlines Co., Ltd. is domiciled by filing a lawsuit.
